According to a November 24 report from PEOPLE, Denise confirmed a surgery planned for December in her response to Aaron’s request, which a judge denied.
As RHOBH fans may recall, Aaron made his request in an attempt to gain access to previously shared funds with Denise, claiming he was in financial distress and facing homelessness.
“[Denise] will be unavailable for a large portion of the month,” her documents stated, signaling the surgery.
Her attorney, Brett. A Berman, also noted, “There is no emergency, no irreparable harm, and no immediate danger that warrants” an emergency order as he requested the January 5 hearing be moved to January 7 and asked a judge to fine Phypers Aaron for “filing this unnecessary and frivolous ex parte application.”
“Instead of reducing the costs of litigation by encouraging cooperation, [Aaron] is only inflaming the situation and causing attorney fees to escalate,” the filing stated. “Accordingly, [Denise] should be awarded sanctions.”
Denise wants the hearing on January 7, “when the court’s calendar is less congested so as to ensure sufficient time can be devoted to the hearing.”
